Not only Google and Facebook worry about the ill effects of fake news. Proof of this is the Senate bill that wants to criminalize so-called fake news. Prepared by Senator Ciro Nogueira (PP-PI), PLS 473/2017 provides for the seclusion of those who share false news.

The measure aims to penalize those who spread information even knowing that it is an untrue fact on issues related to health, public safety, national economy, electoral process or that in any way affect the public interest. The penalty is detention from six months to two years in prison.

If the medium used to share fake news is the internet, the penalty is one to three years in prison. There is another aggravating factor: If sharing is intended for some kind of advantage, the penalty could be increased by up to two thirds.

Law enforcement

Today, false news directed at specific people can be fought because it is a crime of slander, defamation or infamy. However, the creator of PLS ​​claims that in some cases it is not possible to individualize the damage generated by fake news, but it does hurt the right "for the population to receive true news".

The PLS is still in the public consultation stage and anyone can vote for or against the proposal on the eCidadania portal of the Federal Senate.
